The conviction of Knysna Municipality on multiple environmental offenses is not something that should be celebrated. It is a stark reminder of how badly local governance has failed.

Municipalities should not have to be taken to court to comply with environmental legislation. Protecting our rivers, estuary, natural environment and public health is not an optional extra. It is a core responsibility of local government.

The fact that environmental authorities were forced to pursue criminal charges against Knysna Municipality raises serious questions about leadership, oversight and accountability. Court action should never have been necessary. Had the required maintenance, compliance and remedial actions been undertaken when problems first emerged, years of environmental damage, public frustration and costly legal proceedings could have been avoided.

Every Rand spent on investigations, legal processes and court proceedings is a Rand that could have been spent on infrastructure, maintenance and service delivery. Every delay in addressing these issues has come at a cost to residents, businesses, ratepayers and the environment.

The municipality has now admitted guilt and accepted responsibility through a plea and sentence agreement. That admission confirms what residents, businesses and civic organisations have been saying for years: the environmental failures were real, serious and unacceptable.

Choose CX welcomes the fact that the R10 million penalty will be directed towards corrective action and environmental rehabilitation rather than simply being paid into government coffers. The priority must be fixing the damage and preventing future failures. The community will benefit far more from repaired infrastructure and environmental restoration than from a punitive financial penalty alone.

However, the most important question remains unanswered: who will be held personally accountable?

Municipalities do not make decisions. People do. Environmental failures of this magnitude do not happen overnight and they do not occur without warning. They are the result of decisions not taken, maintenance not performed, directives not acted upon and responsibilities not discharged over an extended period.

Knysna residents and ratepayers are entitled to know whether any internal investigations have been conducted, whether disciplinary processes have been initiated and whether any officials or office-bearers will face consequences for the failures that led to these convictions.

Too often in local government, the public pays twice: first through declining services, environmental degradation and economic harm, and then again through the cost of fixing the problem. Meanwhile, those responsible frequently face no meaningful consequences.

The municipality has indicated that consequence management will form part of its response. We welcome that commitment, but it must amount to more than a statement. Accountability requires transparency. The public deserves to know what failures occurred, who was responsible and what actions are being taken to ensure that this situation is never repeated.

Choose CX will be monitoring implementation of the court-ordered interventions closely. We will be looking for measurable improvements in wastewater management, sewerage infrastructure, environmental compliance and waste management operations, including the long-standing concerns surrounding the waste transfer station.

The people of Knysna have heard promises before. What they now require is delivery.

Knysna's natural environment is one of its greatest assets. It underpins our tourism economy, property values, quality of life and international reputation. Allowing that asset to be degraded through neglect is not merely an environmental failure—it is a failure of governance.

Compliance with environmental law should be the starting point of responsible local government, not the result of criminal prosecution. The real test begins now—not with what is promised, but with what is delivered, and who is held accountable if it is not.
